Who are we and what do we do?

The information will be used for purposes relating to education, training, employment, general advice services, well-being and research. MCL may share non-sensitive personal information about you with other organisations, for example the Local Authority, for these purposes.

Sensitive personal information you provide (eg. disability or ethnicity) may be used by MCL for the purposes of equality of opportunity, support for your learning and to minimise risk. It may also be used anonymously for statistical purposes. MCL will ask your permission before sharing sensitive information with other organisations, unless the sharing is permitted by law and necessary.

How the law allows us to use your personal information

Most of the information on the form is collected because it is necessary for your enrolment as a learner or is required by law under The Apprenticeship Skills, Children and Learning Act 2009

 You must provide it in order to enrol on your chosen course/programme.

What is your personal data used for?

The information is used for the exercise of functions of these government departments and to meet statutory responsibilities, including under the Apprenticeships, Skills, Children and Learning Act 2009. It is also used to create and maintain a unique learner number (ULN) and a Personal Learning Record (PLR).

Will your personal data be shared?

The information provided may be shared with other organisations for purposes of administration, the provision of career and other guidance and statistical and research purposes, relating to education, training, employment and well-being. This will only take place where the sharing is in compliance with the Data Protection Act 1998 and GDPR 2018.

We pass most of the information to government agencies to meet funding arrangements. MCL is a Data Processor for the Education and Skills Funding Agency. This means that MCL will pass most of the personal information and some of the sensitive information you provide to the Education and Skills Funding Agency (ESFA), and where necessary it is also shared with the Department for Education (DfE) which is the data controller for personal data processed by ESFA.

You may be contacted after you have completed your programme of learning to establish whether you have entered employment or gone onto further training or education.

You may be contacted by the English European Social Fund (ESF) Managing Authority, or its agents, to carry out research and evaluation to inform the effectiveness of the programme.

The security of your personal information is important to us. This is why we follow a range of security policies and procedures to control and safeguard access to and use of your personal information.

How long will we keep your personal data?

After we deliver a service to you, we have to keep your information as a business record of what was delivered. The type of service will determine how long we have to keep it. Our corporate retention guidelines show how long we will keep it for different services.

Is your personal data processed overseas?

We do not send your personal information outside of the European Economic Area to be processed.

Marketing

At no time will your information be passed to organisations external to us and our partners for marketing or sales purposes or for any commercial use without your prior express consent.

What are your information rights?

Your Information Rights are set out in law and, subject to some exceptions, you have the:

  • Right to rectification - to ask for information to be corrected
  • Right to erasure - to have your personal data deleted
  • Right to object - to how your data is used
  • Right to restriction - to request limits on how your data is used
  • Right to portability - to request that we move your data to another organisation
  • Right of subject access - to request a copy of data the Council holds about you
