Rights of way - registers

Following the Countryside and Rights of Way Act 2000 and the Clean Neighbourhoods and Environment Act 2005, surveying authorities are now required to keep electronic registers of all current applications for the following:

  • Register of current section 53(3) definitive map modification orders

The register contains an entry for each DMMO that has not yet reached its legal conclusion. The register will be regularly updated to show new applications.

  • Register of section 31(6) deposits

The register of section 31(6) deposits contains information about each deposit and declaration that has been made under Section 31(6) of the Highways Act 1980, including the name of the person making the deposit, a description of the area it covers, and the date it was made or renewed. Deposits must be renewed every ten years to remain valid. 

  • Register of section 129A gating orders

The Highways Act 1980 section 129A enables councils to gate a highway if the highway suffers from crime and/or anti-social behaviour, and as part of this process the council is required to keep a register of all gating orders made.


The registers (both paper and electronic versions) are also available for public inspection during normal office working hours (9am to 5pm, Monday to Friday). Please contact the public rights of way officer on 01642 728153 to arrange an appointment, to ensure a member of staff is available to help. Copies of the information contained in the register can be taken, but there may be a charge for this, depending on the amount required.
