Public Space Protection Orders

A Public Space Protection Order (PSPO) applies in Middlesbrough Council-owned cemeteries, and the crematorium on Acklam Road.

In these areas the following rules apply:

  • All dogs within the designated areas must be kept on a lead, with a maximum length of 2 metres at all times
  • All fouling be removed forthwith unless the person in charge of the dog can show a reasonable excuse for failing to do so. Being unaware of the fouling or not have means to remove the faeces will not be seen as a reasonable excuse.
  • It is an offence to use or encourage others to use threatening, insulting or abusive words or behaviour in the designated areas.
  • It is an offence to congregate in a group of more than three people where the behaviour of the group as a whole causes, or is likely to cause harassment, alarm and distress.
  • It is an offence to be in possession of any unsealed container containing alcohol.
  • It is an offence to be in possession of any Class A, B or C class drug as defined by the Misuse of Drugs Act 1971 (excepting prescribed medicine issued to that person by a medical practitioner) and/or will not be under the influence of any drug.
  • It is an offence to use threatening behaviour, intimidation, use or offer violence towards any person.
  • It is an offence to light or attempt to light fires or incite or encourage any other person or persons to light or attempt to light fires. This restriction will not apply to any person who burns incense or other materials for the purposes of a religious practice recognised by the council.

The Order came into force on 31 March 2017 after a formal consultation process. The cemeteries to which the order applies are:

  • Acklam Cemetery
  • Teesside Crematorium
  • Linthorpe Cemetery
  • North Ormesby/St Joseph’s combined Cemetery
  • Thorntree Roman Catholic Cemetery
  • Thorntree Cemetery
  • Teesside Crematorium
